This appeal concerns the existence of a contract between the defendant insurers relating to their respective liabilities for payment of a settlement to the plaintiff Frank Mitchell. The plaintiff was a passenger in an automobile insured by Western Casualty & Surety Company (Western) and was injured when it collided with an automobile insured by the Hardware Mutual Casualty Company (Hardware). The accident occurred on December 30, 1960, in Monroe county when the auto insured by Western swerved into the lane of the oncoming Hardwares car in order to avoid bales of hay in its lane of travel which had fallen off a farmers truck insured by American Family Insurance Company (American).
